1. Acceptance
These Terms govern your use of Hykaro, a security-audit service operated by Cyril Pereira ("we", "us"). By creating an account or purchasing a scan, you accept these Terms. If you act on behalf of an organization, you confirm you are authorized to bind it.
2. The service
Hykaro lets you connect a Git repository or a URL, run automated security, quality, and accessibility scans, and generate a white-label PDF report. Hykaro documents and attests the state of a project at a given date. It does not certify security and is not a substitute for a manual penetration test or a legal compliance audit.
3. Your responsibilities
- Authorization: you may only scan assets you own or are explicitly authorized to test. You are solely responsible for having the right to connect any repository or URL.
- Accounts: keep your credentials secure; you are responsible for activity under your account. MFA is available and recommended.
- Acceptable use: no use of Hykaro to attack third-party systems, bypass quotas, resell access without agreement, or violate any law.
4. Plans, pricing & payment
- Per-project (one-shot): a single audit with a defined re-scan window, priced per project (from €199). [TO VALIDATE: final tier prices]
- Subscriptions: organization plans (Solo / Studio / Agency) billed monthly or yearly, granting continuous CI ingestion and quotas.
- Payments are processed by Stripe. Prices are stated excluding applicable taxes unless indicated otherwise. [TO VALIDATE: VAT handling]
5. Refunds
- Full refund if a scan fails on our side or the delivered report is empty due to a fault attributable to us.
- No "changed my mind" refund once a scan has been delivered, consistent with a digital deliverable produced on demand.
- Subscriptions: cancel anytime; cancellation takes effect at the end of the current billing period, with no further charge. [TO VALIDATE: statutory withdrawal rights for EU consumers vs. B2B]
6. Deliverables & intellectual property
- Your content (code, URLs, results, reports about your projects) remains yours. You receive a license to use the generated reports for your own commercial purposes, including delivering them to your clients.
- Our platform (software, the Hykaro engine, scanner curation, branding) remains ours. These Terms grant you no rights to it beyond using the service.
7. Availability
We aim for high availability but provide the service "as is" and "as available". We may perform maintenance and may change or discontinue features. [TO VALIDATE: SLA for paid subscription tiers]
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising from the service is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect or consequential damages, nor for vulnerabilities that exist in your systems independently of Hykaro. Hykaro's findings are informational and do not guarantee the absence of vulnerabilities.
9. Data protection
Our handling of personal data is described in the Privacy Policy. A Data Processing Agreement is available on request.
10. Termination
You may close your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or abuse, with notice where reasonable.
11. Governing law
These Terms are governed by French law. Disputes fall under the competent courts of [TO VALIDATE: jurisdiction / city], subject to any mandatory consumer-protection rules. We will attempt to resolve disputes amicably first.
